4. User Content & AI Output
4.1. Your User Content
You retain all ownership rights, including intellectual property rights, in the files, data, text, and prompts you submit to the Service ("User Content").
4.2. License Grant to DatumFuse.AI
To enable us to operate the Service, you grant **Datum Fuse LLC** a limited, non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, process, and transmit your User Content solely for the purpose of providing and maintaining the Service for you. This license terminates when you delete your User Content or your account, subject to our data retention policies.
4.3. AI-Generated Output
The Service may generate new content based on your User Content, such as charts, summaries, or analyses ("Output"). Due to the nature of machine learning, Output may not be unique across users and the Service may generate the same or similar Output for other users.
4.4. Ownership and Use of Output
Subject to your compliance with these Terms, **Datum Fuse LLC** grants you full rights to use the Output for any lawful purpose, including personal or commercial use. You are solely responsible for the Output you generate and its subsequent use.
4.5. Responsibility for Content
You represent and warrant that you have all necessary rights to your User Content and that its use by us as contemplated in these Terms will not infringe upon the rights of any third party. DatumFuse.AI does not review or endorse any User Content.
5. Acceptable Use Policy
You agree not to use the Service for any purpose that is unlawful or prohibited by these Terms. You specifically agree not to:
(a) Upload or generate any content that is illegal, defamatory, harassing, abusive, fraudulent, obscene, or that promotes violence or hate speech.
(b) Use the Service to infringe upon any third party's intellectual property rights, including copyrights, patents, or trademarks.
(c) Engage in any activity that could harm, disable, overburden, or impair our servers, networks, or the Service itself.
(d) Use any automated means, such as scrapers or bots, to access the Service, other than through our officially supported APIs.
(e) Attempt to reverse-engineer, decompile, or otherwise discover the source code or underlying components of our Service, including the AI models.
(f) Represent that Output from the Service was human-generated when it is not.
6. Payments, Subscriptions, and Refunds
6.1. Fees
For Premium Tiers, you agree to pay all applicable fees as described on our pricing page. All fees are in U.S. Dollars and are non-refundable, except as required by law or as explicitly stated in our refund policy.
6.2. Billing
We use a third-party payment processor to bill you through a payment account linked to your account. The processing of payments will be subject to the terms, conditions, and privacy policies of the payment processor in addition to these Terms.
6.3. Automatic Renewal
Subscription fees will automatically renew for an additional period equal in length to the expiring subscription term, unless you cancel your subscription through your account settings before the end of the current term.
6.4. Price Changes
We reserve the right to change our subscription prices. We will provide you with reasonable prior notice of any price changes.
7. Disclaimers & Limitation of Liability

7.2. AI Output Disclaimer
YOU ACKNOWLEDGE THAT AI-GENERATED OUTPUT IS PROBABILISTIC AND MAY CONTAIN INACCURACIES, ERRORS, OR OMISSIONS. IT IS NOT INTENDED TO BE A SUBSTITUTE FOR PROFESSIONAL ADVICE. YOU MUST INDEPENDENTLY EVALUATE THE ACCURACY AND APPROPRIATENESS OF ANY OUTPUT BEFORE USING OR RELYING ON IT.
7.3. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL **DATUM FUSE LLC**, ITS AFFILIATES, DIRECTORS, OR EMPLOYEIS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF THE SERVICE; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS; OR (C) ANY BUGS, VIRUSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY.
